1. PPWR adopted EP Plenary with huge majority

On 24 Apri 2024, the European Parliament’s Plenary formally adopted the provisional agreement reached with EU Member States on the Packaging and Packaging Waste Regulation (PPWR).

The Regulation was adopted with 476 votes in favour, 129 against and 24 abstentions.

As a reminder, the adopted text is similar to the provisional agreement, except for the changes on the article numbers and some minor clarification changes in the text.

Following the Plenary approval of PPWR provisional agreement in the EP Plenary, please find here the final version of the text that has been adopted.

The European Commission / DG Environment will take into due consideration the concerns raised by the European Wooden Pallets and Packaging Manufacturers (FEFPEB) regarding certain provisions of the Packaging and Packaging Waste Regulation (PPWR), particularly Article 26.1 on reuse targets for transport packaging

Further stakeholders feedback on the regulation will be gathered during forthcoming consultations on the development of secondary legislation.

Next steps

• As legal linguistic checks on the text have not been done yet, any further legal changes to the text will be adopted through the corrigendum procedure after the elections scheduled in June (probably in September). These changes should, in principle, be minor and will not affect the main provisions or targets in the provisional agreement.
• Once the legal checks are done by the legal service in the Parliament, Commission and the Council. The text will be tabled in the Plenary and will be considered approved within 24 hours, unless a request is made by a political group or 36 MEPs, to put it to vote.
• The Council will formally adopt the PPWR text and will be then published in the Official Journal of the EU.
• The text will enter into force 20 days after the publication and enter into application 18 months from the date of entry into force.

2. Update EUDR: Pressure on postponement of implementation increasing

Please find here a copy of the letter sent by the Commissioner Janusz Wojciechowski (European commissioner for agriculture) to the President of the European Commission, von der Leyen.

1. The letter states “I have also received numerous letters illustrating the difficulties our farmers, forest-owners and businesses faces in the implementation of this Regulation. They report administrative burden and uncertainties, and call for a deferral of the deadline for the implementation…….Let me conclude by reiterating that in order to make the EU Deforestation Regulation a success for the Green Deal on a global scale, we need more time to address the substantial concerns raised by Member States and our partners……..It is our obligation to take all the necessary measures to ensure continuity of business and supply of products covered by the regulation and to avoid any disruption of trade  due to a hasty implementation of this regulation”

Be also informed that on 15 May 2024, the Brussels based forestry industry organizations (a.o. CEI Bois) together with COPA-COGECA will have a physical meeting with the Commissioner Wojciechowski.

Moreover, on 27 April 2024 , the Austrian Ministers for Agriculture and the Economy (Norbert Totschnig and Martin Kocher) sent also a letter to Ursula von der Leyen calling for a postponement of the entry into application of the Regulation and for a revision of the Regulation. The two ministers believe that the implementation of the regulation is likely to generate too much red tape for Europe's small farms and for the Member States. The letter reports concern as well related to the delay in the countries benchmarking and the consequential disproportionality in the ue diligence obligations.
